Statement of Afghanistan Independent Bar Association in Exile Regarding the decision of the Taliban Supreme Court dated 8th Thor 1403(27/04/2024)
The Taliban De facto Supreme Court, through Declaration No. (631-632/360-361) dated 08/02/1403 (27/04/2024), has issued a ruling insulting defense lawyers and prohibiting their representation in criminal lawsuits deemed to involve divine rights and contradict accepted Sharia, Applicable laws, and international regulations. Suspects and defendants in such cases are deprived of their right to legal representation during the prosecution process. Furthermore, the ruling imposes unjust and unlawful criteria for determining defense lawyer fees and requires unnecessary tests for defense lawyers.
